    EIELSON AFB, Alaska - Alaska recently became the third state to legalize marijuana for adults over the age of 21.

    However, military members are still prohibited from using, possessing, manufacturing, distribution and the introduction of marijuana on an installation, vessel, vehicle or aircraft used or under the control of the armed forces.

    According to Article 112a of the Uniform Code of Military Justice, a member can be punished with a dishonorable discharge and up to five years of confinement.

    "Even with the state laws changing legalization of marijuana, we are still expected to uphold the standards set by the UCMJ and federal law," said Capt. Kristin Carl, 354th Fighter Wing Judge Advocate assistant staff judge advocate.

    Military members are not the only ones who are affected. Civilians, dependents and visitors, on a military installation are subjected to federal law, which bans possession and distribution of marijuana.

    The Defense Department upholds the standard of a drug-free workplace. Use of illegal drugs on or off duty by federal civilians is prohibited, regardless of state legalization of marijuana. The illegality is based on federal criminal statutes on controlled substances, which is not affected by any marijuana legalizing state laws.

    When state and federal laws contradict each other, federal law becomes the controlling law.

    "Even though it is legal for civilians downtown, we must remember the Air Force has a zero tolerance policy for substance abuse, to include marijuana," said Master Sgt. Douglas McPherson, 354th Operations Group first sergeant.
