FORT HOOD, Texas – Lt. Gen. Donald Campbell, III Corps and Fort Hood commander, has notified defense counsel for Maj. Nidal M. Hasan that Campbell is available to meet with the Defense on May 6. The purpose of the meeting is so defense counsel can present anything for Campbell’s consideration before Campbell makes a disposition decision in Hasan’s case.
Defense Counsel had a similar meeting with Col. Morgan Lamb, Hasan's brigade commander, where defense counsel likewise presented matters for Lamb’s consideration. After the meeting, Lamb, serving as special court-martial convening authority, decided to forward the charges pending against Hasan to a general court-martial convening authority for disposition.
Campbell, who serves as a general court-martial convening authority, has several options concerning charges forwarded to him for disposition. Options include sending pending charges to trial by court-martial and deciding whether such charges should be tried as capital offenses, dismissal of charges, or sending charges to a different convening authority for disposition.
Campbell will make his disposition decision in Hasan’s case in due course after his meeting with defense counsel, and no specific date has been set for that decision.
The accused is presumed innocent until and unless proven guilty in a court-martial/court of law.
